Off-Road Construction Equipment Not Liable to Motor Vehicle Tax: Supreme Court

The Supreme Court has held that heavy earth-moving machinery and construction equipment such as dumpers, loaders, excavators, dozers, surface miners and rock breakers—when used exclusively within factory or enclosed premises—do not qualify as “motor vehicles” liable to registration or road tax under the Motor Vehicles Act, 1988 and the Gujarat Motor Vehicles Tax Act, 1958. The bench of Justice Pankaj Mithal and Justice Prasanna B. Varale addressed a common legal question across multiple appeals: whether heavy construction equipment, designed and used for off-road operations within industrial premises, falls within the statutory definition of “motor vehicle” under Section 2(28) of the Motor Vehicles Act and can therefore be subjected to state motor vehicle tax. The appellant/assess, Ultratech Cement Ltd., which operates large cement plants in Gujarat, uses various heavy earth-moving machines exclusively inside its factory and mining premises. These machines are transported to the sites in dismantled or “knocked-down” condition on trailers and are not driven on public roads. Initially, regional transport authorities had acknowledged that such vehicles did not require registration. However, in 1999–2000, the Gujarat transport authorities reversed their stance, insisting on registration and levy of road tax, leading to substantial tax demands and payments under protest by the company. Ultratech challenged the demands, relying on manufacturer certificates and expert opinions stating that the machines were designed solely for off-road industrial use and were not road-worthy. The Gujarat High Court rejected the challenge in 2011, prompting the appeals before the Supreme Court. The Supreme Court anchored its analysis in Article 265 of the Constitution, which mandates that no tax can be levied without authority of law, and Entry 57 of List II of the Seventh Schedule, which empowers states to tax only those vehicles that are “suitable for use on roads.” Interpreting Section 2(28) of the Motor Vehicles Act, the Court emphasized its two-part structure: while the definition broadly includes mechanically propelled vehicles adapted for use on roads, it expressly excludes “vehicles of a special type adapted for use only in a factory or in any other enclosed premises.” The Bench held that the construction equipment used by Ultraltech squarely falls within this exclusion. The Court further noted that the Gujarat Motor Vehicles Tax Act cannot travel beyond the constitutional limitation imposed by Entry 57. Since the state’s taxing power is confined to vehicles suitable for road use, off-road industrial equipment cannot be brought within the tax net merely because they are mechanically propelled. The Bench reaffirmed the principle laid down in Bolani Ores Ltd. v. State of Orissa (1974), which held that the phrase “adapted for use upon roads” means vehicles that are suitable and intended for road use. Vehicles operating solely within enclosed premises and not deriving any benefit from public road infrastructure, the Court reiterated, cannot be subjected to road tax. The Court also took note of certificates issued by manufacturers such as Bharat Earth Movers Ltd. and Hindustan Motors, as well as the Automotive Research Association of India, all confirming that the equipment was meant for off-road industrial operations and lacked road-worthiness certification. These materials, the Court observed, were not rebutted by the State. Additionally, reference was made to a 2020 circular of the Ministry of Road Transport and Highways clarifying that such off-road construction equipment does not require registration as motor vehicles. While acknowledging that executive circulars cannot override statutes, the Court held that they are binding on departmental authorities. An important factor in the Court’s reasoning was that Schedule I of the Gujarat Motor Vehicles Tax Act does not prescribe any rate of tax for construction equipment vehicles.
