CBIC Notifies Promotion of IRS (Customs & Indirect Taxes) Officers to Joint Commissioner Rank for Vacancy Years 2025 and 2026

In a significant administrative development, the President of India has approved the promotion of officers belonging to the Indian Revenue Service (Customs & Indirect Taxes) to the grade of Joint Commissioner of Customs & Indirect Taxes (Level-12) on a regular basis. The promotions have been granted against the vacancy years 2025 and 2026, subject to specified conditions.

Promotions for Vacancy Year 2025 and 2026

As per the official order, officers whose names are listed in Annexure-I have been promoted against the vacancy year 2025. These promotions will take effect from the date the officers assume charge of the post of Joint Commissioner.

Similarly, officers mentioned in Annexure-II have been promoted against the vacancy year 2026. However, their promotion will be effective only from the date of assumption of charge, and not earlier than 1 January 2026.

‘As Is Where Is’ Basis Posting

The order clarifies that all promotions are being made on an “as is where is” basis until regular postings are approved by the competent authority. This means that the promoted officers will continue in the same office where they are presently posted and assume charge of the post of Joint Commissioner at that location, until further orders.

Subject to Court Cases and Vigilance Status

The promotions are explicitly stated to be subject to the outcome of any related court cases, if pending. Further, strict instructions have been issued to senior field formations to ensure compliance with vigilance norms.

The concerned Principal Chief Commissioners, Principal Directors General, Chief Commissioners, Directors General, Principal Commissioners, and Principal Additional Directors General of CBIC have been directed to verify the status of the promoted officers. If any officer is under suspension, facing a charge sheet, prosecution, or undergoing a penalty, such officer must not be allowed to assume charge of the promotional post. Any such instance is required to be reported to the Board immediately.

Provisions for Officers on Deputation

Special provisions have also been laid down for officers currently serving on deputation. Their promotion will become effective only upon their return to the cadre and assumption of charge of the post of Joint Commissioner.

However, if an officer opts to continue on an ex-cadre post, the borrowing authority may submit a proposal to the Board seeking proforma promotion, in accordance with existing instructions. Such proposals must be forwarded by 9 January 2026 for consideration.
