SC Stays GST Proceedings Over Vague, Unsubstantiated Rs. 1.52 Crore SCN

The Supreme Court has stayed all further proceedings in a ₹1.52 crore GST demand case after expressing serious reservations about the validity and clarity of the show cause notice (SCN) issued by the State Tax Department. The Bench comprising Justice J.B. Pardiwala and Justice K.V. Viswanathan observed that the notice, issued under Section 74 of the GST Act, appeared “bereft of material particulars” and failed to disclose any concrete basis for alleging fraud, willful misstatement, or suppression of facts—grounds that are mandatory for invoking the extended limitation period under Section 74. The Petitioner, GR Infra argued that the Department had issued a highly defective notice that merely listed figures but did not explain the reasoning behind the allegations. The Supreme Court found prima facie merit in this contention, noting that apart from numerical computations, the SCN did not disclose why the authorities believed the petitioner had engaged in tax evasion. The Court issued notice to the Madhya Pradesh tax authorities and permitted dasti service, while also directing a stay on further proceedings until the matter is taken up after four weeks. Background The controversy began when GR Infra approached the Madhya Pradesh High Court seeking quashing of the June 13, 2025 show cause notice. The petitioner contended that if there was no established fraud or suppression, the proper course of action would have been to proceed under Section 73, which carries a shorter limitation period of three years. GR Infra relied on several judicial precedents, including the Supreme Court’s decision in Uniworth Textiles Ltd. v. CCE, which emphasizes that allegations of fraud must be clearly articulated and supported by material particulars. However, the Madhya Pradesh High Court refused to interfere, holding that the petitioner had an adequate opportunity to present its objections before the adjudicating authority. The Division Bench of Justice Vivek Rusia and Justice Binod Kumar Dwivedi noted that a detailed 191-page draft notice prepared by the audit wing after a search under Section 67 indicated that the Department had material suggesting willful evasion. The High Court pointed out that courts should not ordinarily intervene at the show cause notice stage, particularly when statutory appellate remedies are available. Emphasizing judicial restraint, the Bench underscored that disputed questions of fact—such as whether the evidence truly establishes fraud—must be examined by the proper authority and not by the writ court. The disputed tax demand of ₹1,52,56,431 arose from alleged mismatches between outward and inward supplies reflected in GSTR-3B and e-way bills, ineligible input tax credit relating to site office expenses, and tax liability arising from post-supply vendor cancellations. The Department claimed that these discrepancies demonstrated suppression and misreporting. GR Infra countered that these were accounting mismatches or clerical anomalies, and that no element of fraud or intentional evasion was ever established. Conclusion By staying the proceedings, the Supreme Court has signaled that vague and non-speaking notices invoking fraud-based provisions under the GST law cannot withstand judicial scrutiny. The Court’s intervention is significant because the distinction between Sections 73 and 74 directly impacts limitation, penalties, and the burden of proof. A defective notice issued under Section 74 not only prejudices the assessee but also undermines the legal safeguards intended to prevent arbitrary invocation of the extended limitation period. The Supreme Court’s final decision is expected to have broader implications for GST administration across the country. It may reinforce the requirement that tax authorities must clearly articulate the factual basis for alleging fraud, misstatement, or suppression before resorting to harsher provisions. For now, all further proceedings against GR Infra remain stayed, and the matter will be re-examined once the Revenue responds to the notice issued by the apex court.
