CESTAT Quashes Order Revoking Licence Of Customs Broker Accused Of Facilitating Exports For Non-Existent Firms

In a significant ruling reaffirming the scope and limits of due-diligence obligations under the Customs Brokers Licensing Regulations (CBLR), the Customs, Excise & Service Tax Appellate Tribunal (CESTAT), New Delhi, has quashed an order revoking the licence of a customs broker accused of facilitating exports for allegedly non-existent firms. There was no evidence to establish violations of Regulations 10(d), 10(e) or 10(n) of the CBLR, 2018. The order—passed by a Bench comprising Justice Dilip Gupta (President) and P.V. Subba Rao (Technical Member)—sets aside the Commissioner of Customs’ decision to revoke the licence, forfeit the security deposit and impose a penalty of ₹50,000. The Directorate General of Analytics and Risk Management (DGARM) had flagged certain exporters as "risky" after data analysis suggested they could be involved in fraudulent export activities. Physical verification by jurisdictional GST officers later reported that two exporters linked to the customs broker through filed shipping bills—M/s MJ Expo Trade India and M/s Roomwell Tradex Pvt. Ltd.—were not found at their registered premises. Based on these findings, the Commissioner issued a show-cause notice alleging that the customs broker failed to verify the exporters’ identity and functioning, thus violating CBLR norms. An inquiry was initiated, but the broker did not participate in the proceedings before the inquiry officer, though a written reply was submitted. The Commissioner concluded that the customs broker failed to advise clients as required under Regulation 10(d); failed to exercise due diligence under Regulation 10(e); and failed to independently verify the functioning of the exporter at the declared premises under Regulation 10(n). This led to the revocation of the licence and forfeiture of the security deposit. The CESTAT conducted a detailed examination of each alleged violation and found no basis for the Commissioner’s conclusions. The Tribunal noted a complete absence of evidence showing that the broker failed to advise its clients about compliance with customs laws. Merely failing to appear before the inquiry officer, it said, cannot be equated with violating regulatory obligations. There was no allegation or evidence that the broker provided incorrect information to clients. The Commissioner’s reasoning, the Tribunal said, conflated non-participation in inquiry proceedings with due-diligence failures, which is legally untenable. This was the core allegation. The Tribunal, however, held verification of IEC and GSTIN through official documents and online checks meets the regulatory requirement. A customs broker is not expected to physically verify a client’s business premises. Government-issued documents must be treated as reliable, authentic and independent unless proven otherwise. The responsibility for issuance of GST registration and IEC lies with the authorities, not the customs broker. In a strongly worded observation, the Tribunal remarked that questioning the authenticity of documents issued by DGFT or GST departments without evidence amounts to making “serious and unwarranted aspersions” on government officers themselves. The CESTAT also emphasized that Regulation 10(n) does not require continuous surveillance of clients or verification of their existence at every stage of operations. Customs Brokers are not inspectors tasked with investigating genuineness of IEC/GSTIN (relying on the Delhi High Court’s Kunal Travels ruling). Reliance on government-issued documents is sufficient unless the broker is aware of fraud. Regulatory obligations must be read reasonably, keeping in mind operational feasibility. The Tribunal concluded that the customs broker had fully met the verification requirements under Regulation 10(n) and that the Commissioner’s findings were unsupported by evidence.
