CESTAT Upholds Confiscation of Rs. 77 Lakh Imported Electronic Goods Over Fake Invoices and Smuggling Allegations

The Customs, Excise and Service Tax Appellate Tribunal (CESTAT), Principal Bench, New Delhi, has upheld the confiscation of imported public address (PA) systems and electronic equipment worth over ₹77 lakh, after finding that the importer failed to prove lawful import and had relied on fabricated invoices and fictitious suppliers. A two-member bench comprising Dr. Rachna Gupta (Judicial Member) and P.V. Subba Rao (Technical Member) dismissed the appeals against the Commissioner of Customs’ 2011 order, which had imposed a ₹20 lakh redemption fine and ₹2 lakh penalties each on the firm’s proprietor and manager under the Customs Act, 1962. The case originated from an investigation by the Directorate of Revenue Intelligence (DRI), which received intelligence that a Delhi-based electronics importer was bringing in foreign-brand PA systems and sound equipment without paying customs duty and was also indulging in gross undervaluation and misdeclaration. Acting on this tip, DRI officers conducted searches at multiple premises and seized imported goods under three panchnamas dated January 5, 2010, collectively valued at ₹77,16,288. The seizures were made on the belief that the goods were smuggled and were not supported by valid duty-paid documents. Following investigation and statements recorded under Section 108 of the Customs Act, the Commissioner of Customs (Preventive), New Delhi, in his Order-in-Original No. 09/Commr/HKC/2011 dated July 29, 2011, ordered confiscation of the seized goods, allowing redemption on fine and imposing monetary penalties. The importer claimed that the goods had been purchased locally from three suppliers—M/s CINETEKK (Pondicherry), M/s A-One Electronics (Delhi), and M/s Sun Infonet Pvt. Ltd. (Delhi)—and submitted invoices to that effect. However, verification by DRI revealed significant discrepancies CINETEKK confirmed that the invoices produced were never issued by them. A-One Electronics was found to be a non-existent entity. Sun Infonet Pvt. Ltd. acknowledged issuing invoices, but clarified that their goods bore MRP/RSP stickers, while the seized goods did not, indicating that the invoices did not correspond to the goods seized. The adjudicating authority held that these findings proved the goods were smuggled and ordered confiscation under Sections 111(a), (b), (d), and (l) of the Customs Act, along with penalties under Section 112. The importers contended that the goods were legally imported, supported by valid Bills of Entry. Absence of MRP stickers was not evidence of smuggling. Payments to local suppliers were made through cheques, proving bona fide transactions. They also alleged that the DRI acted at the behest of a private individual, a claim rejected by the Commissioner as baseless. Despite repeated adjournments, no representative appeared for the appellants during the Tribunal hearings. Proceeding ex parte, the bench relied on the Supreme Court’s ruling in Balaji Steel Rolling Mills v. CCE & Customs (2014), holding that the Tribunal must decide cases on merits even in the absence of the appellants. The Tribunal observed that the Commissioner had followed the principles of natural justice, allowing cross-examination of all key witnesses whose statements were relied upon. It noted that the cross-examinations only reinforced the Revenue’s case. “The statements of witnesses and their cross-examination categorically established that the documents submitted were not related to the seized goods,” the bench remarked. Finding no merit in the appeals, the CESTAT held that the confiscation and penalties were fair, reasoned, and legally sound, and upheld the Commissioner’s order in full. The Tribunal dismissed both appeals, confirming confiscation of imported goods worth ₹77.16 lakh; redemption fine of ₹20 lakh; and penalties of ₹2 lakh each on the individuals concerned. The bench concluded that the goods were imported without valid documents and that the use of fabricated invoices from non-existent suppliers clearly established smuggling and misdeclaration.
