The Jharkhand High Court has granted the bail to Avnish Jaiswal, person accused of GST evasion worth Rs. 31 crores for different Financial Years (FYs).
The petitioner, Avnish Jaiswal has been made accused under Sections 132(1)(b), 132(1)(c), 132(1)(f) and 132(1)(1) & 132(5) of the Central Goods and Service Tax Act, 2017 and Sections 61, 316 & 322 of the B.N.S., 2023, pending in the court of Abhishek Prasad, Special Judge, Economic Offences, Jamshedpur. Petitioner is alleged to have evaded GST worth Rs. 31.00 crores for different financial years.
The petitioner submitted that the prosecution report has been submitted in this case. It was further submitted that the maximum punishment for evasion of GST is five years and the petitioner has remained in custody for almost three months.
The Director General of GST Intelligence, submitted that the petitioner is the main mastermind of evasion of GST.
The bench of Justice Ambuj Nath released the petitioner, on bail on furnishing bail bond of Rs.20,000 with two sureties of the like amount each, to the satisfaction of Abhishek Prasad, Special Judge, Economic Offences, Jamshedpur.
