Anticipatory Bail Made Absolute for Assam Trader in GST Consignment Dispute: Gauhati High Court

The Kohima Bench of the Gauhati High Court has made absolute the interim anticipatory bail granted to Shri Abhimanyu Kumar @ Monu Singh, a forest produce trader from Kamargaon, Assam, in connection with a case involving a disputed consignment and GST-related documentation.

The bench of Justice Yarenjungla Longkumer observed that  the petitioner has been cooperating with the investigation and has appeared on 29.07.2025 before the Investigating Agency. Therefore, the Interim Order dated 26.06.2025 can be made absolute. However, the petitioner shall continue to cooperate with the investigation and shall appear as and when summoned by the Investigating Officer without fail and provide all the documents, which he was directed to produce positively before the Investigating Agency.

According to the latest status report submitted by the Investigating Officer, the petitioner appeared before the agency on July 29, 2025, but failed to produce GST bills or cash transaction records as directed. Although he denied receiving the consignment in question in 2024, the complainant had already submitted all relevant GST and e-way bills.

The petitioner has now been directed to reappear before the Investigating Agency with the necessary documents. His counsel argued that other co-accused individuals — Pradeep Singh and Guneshwar Bharali — had already been granted bail by a coordinate bench on July 10, 2025, in a related case (AB/1565/2025), and thus sought to make the interim order permanent.

Noting the petitioner’s cooperation with the investigation and his appearance on the scheduled date, the Court allowed the anticipatory bail to be made absolute, with the condition that he continues to cooperate and comply with all directions from the Investigating Officer.
