The special court orders registration of FIR under POCSO Act against the producers of the Marathi film “Varan Bhaat Loncha Kon Nay Koncha” alleging that the movie contains sexually explicit content involving minors.
Applicant is the President of an organization Bhartiya Stree Shakti and authorized by it to file the application. It is submitted that, accused has directed the movie “Varan Bhaat Loncha Kon Nay Koncha” and released the trailer of the movie on various online platforms. The trailer contains sexually explicit contents involving minors. It also displays use of obscene abuses, violence, indecent acts by minors and indecent representation of women.
The applicant contended that, after some users reported inappropriate content, the trailer was removed from YouTube, but is still available on other online platforms and being circulated. The trailer is downloaded and a CD containing the same, is filed along with a complaint. The movie is now released and it is found that, few scenes from the trailer were deleted, few were blurred and some are still shown in the movie.
She argued that complaints were filed with Mahim Police Station, Deputy Commissioner of Police but no action was taken. The copies of the complaints are annexed. The application is supported with an affidavit of the applicant and documents.
The designated Judge under Protection of Children from Sexual Offences Act, 2012, Nazera S. Shaikh, stated that the documents filed on record are sufficient to hold that prima-facie case is made out by applicant to issue directions U/Sec.156(3) of Cr.P.C. against accused persons.
The court directed thet Senior Police Inspector of Mahim Police Station, to investigate the case as per Section 156 (3) of the Code of Criminal Procedure and take appropriate action as per law.
