Alleged Illegal Sale of Nazul Land: Delhi High Court Issues Notice

The Delhi High Court has issued notices to the Delhi Development Authority (DDA), the Government of India, the Delhi Government, SDM Karol Bagh, SHO Paharganj, MCD Delhi, Sub-Registrar III, Sardar Pawanjit Singh Bawa, and all buyers involved in the alleged illegal sale of Nazul land worth approximately Rs. 150 crores. 

A bench of Justice Manoj Jain has issued the notices after a petition was filed by Rajender Singh Juneja and others, raising serious concerns about unauthorized transactions involving government land.

The disputed properties covering approximately 2525 square yards, were originally leased in 1921 by the Deputy Commissioner of Delhi to Mumtaz Ali for 20 years. Over the decades, the leasehold rights passed through various hands, with the last known leaseholder being Sardar Jagjit Singh Bawa. Following the expiry of these leases in 1980 and 1981, the land legally reverted to the Government of India through the DDA.

However, in 2010, Sardar Jagjit Singh Bawa’s son, Pawanjit Singh Bawa, allegedly executed sale deeds transferring the land to private buyers without legal authority. The petitioners claim that these transactions were carried out in collusion with high-ranking DDA officials and powerful political figures, leading to an attempt to forcibly evict long-standing residents of the area.

The petitioners—Rajender Singh Juneja, Rajesh Kumar, and Bhupendra Singh—asserted that the sale of the land was illegal, as Nazul properties cannot be transferred without government authorization. They allege that after purchasing the land, the new owners, with political and administrative backing, began pressuring residents to vacate their homes through threats, coercion, and monetary inducements.

Despite filing multiple complaints with the Prime Minister’s Office, the President of India, the Chief Justice of the Supreme Court, and various government agencies, the petitioners claim that no action was taken. Official records indicate that the Prime Minister and the Government of India repeatedly directed the DDA to investigate the matter, yet the agency allegedly failed to act.
