The Ministry of Corporate Affairs notified higher additional fees for late filing.
The government empowered under sections 396, 398, 399, 403 and 404 read with sub-sections (1) and (2) of section 469 of the Companies Act, 2013, the Central Government notified the Companies (Registration Offices and Fees) Amendment Rules, 2022 which seeks to amend the Companies (Registration Offices and Fees) Rules, 2014.
The additional 18 times of fees is applicable in case if there is a delay in filing of certain forms and not by default to all Companies. With effect from July 1, 2022, additional fees on form will be increased to 18 times from existing 12 times of normal fees. However, this excludes Annual Filings which are charged at Rs. 100 per day without any upper limit. It is pertinent to mention here that this is merely filing fees.
In the Companies (Registration Offices and Fees) Rules, 2014, in item I (Fee for filing under section 403 of the Companies Act, 2013), for sub-item B, the sub-item shall be substituted, namely “additional fee and higher additional fee (in certain cases) shall be applicable for delay in filing of forms other than for increase in Nominal share capital or forms under section 92/137 of the Act or forms for filing charges.”
