The Allahabad High Court in the case of Mohit Yadav v/s Union Of India Through Secretary Ministry Of Youth Affairs and Sports And Ors. directed the Sports Authority of India to ensure the Indian team’s participation in Asian Men’s Handball Championship.
A.S.G. Surya Bhan Pandey, obtained the instructions according to which, necessary measures, as regards the disbursement of funds could not be taken due to internal election dispute as regards the constitution of management in Handball Federation of India. The dispute is subjudice before the Punjab and Haryana High Court wherein an administrator is stated to have been appointed.
The division bench of Justice Attau Rahman Masoodi and Justice Narendra Kumar Johari, noted that nothing is brought to their notice that the administrator has finalized any list of players which on the contrary was provisionally finalized with due participation of the representatives of the Sports Authority of India and the final list was forwarded to the concerned organization holding the event of 20th Asian Men’s Handball Championship at Saudi Arab.
The court directed the Sport Authority of India to ensure participation of the Indian Handball team as has been finalized for which a sanction of budget has also been earmarked.
The court made it clear that the Sport Authority of India may take a decision to do the needful notwithstanding the fact that some dispute with respect to the constitution of the management body in Handball Federation of India is subjudice before the Punjab and Haryana High Court.
The court further added that the country should not remain unrepresented in the event for which the budget is available with the Sport Authority of India.
