Allahabad High Court Directs DM To Decide On Compensation In Case Of Teacher’s COVID Death During Election Duty

The Allahabad High Court in the case of Aryan Srivastava v/s State Of U.P. And Ors. directed District Magistrate to decide on compensation in case of teacher’s death due to COVID during election duty.

Petitioner Aryan Srivastava’s mother was assigned election duty during Panchayat Elections during which she appears to have contracted COVID-19 and has died thereafter. Claim for payment of compensation in terms of the Government Order dated 1st June, 2021 appears to have been made before the respondent, but no decision upon it has been taken.

Standing Counsel representing the State authorities submits that such grievance would be examined by the competent authorities expeditiously.

The division bench of Justice Ashwani Kumar Mishra and Justice Vikram D. Chauhan while disposing of the petition directed the District Magistrate, Jaunpur to ensure that the petitioner’s claim for payment of compensation is examined in terms of aforesaid Government Order, bypassing a reasoned order, within a period of three months from the date of production of copy of this order.
